Result of “Yes” Vote: “Yes” vote repeals ORS 830.624, which requires anyone aged 14 or older to carry waterway access permits to operate certain nonmotorized boats and sailboats.
Result of “No” Vote: “No” vote retains statute requiring waterway access permits for anyone aged 14 or older to operate certain nonmotorized boats and sailboats unless exception applies.
Summary: Measure repeals ORS 830.624, which requires anyone aged 14 or older to carry a waterway access permit to operate a nonmotorized boat 10 feet or longer or a sailboat between 10 and 12 feet long. Permit transferable between qualifying boats and must be shown to peace officers upon request. Violation constitutes Class D violation. Statute does not apply to “free boating days” or to persons operating boat: owned by boat livery operator displaying proof of permit; on federally designated wild and scenic rivers with separate fee system; who is engaged in law enforcement, public safety or official government business. Exceptions also include out-of-state residents meeting certain requirements, and members of a federally recognized Indian tribe engaged in tribal fishing or a tribal ceremony.
